These Terms of Service (“Terms”) govern your access to and use of the PHOS website, your purchase of PHOS products, and any subscription you enroll in. Please read them carefully. By browsing this site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.

01 · Acceptance of terms

By accessing this website or placing an order, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), that the information you provide is accurate, and that you accept these Terms together with our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not use the site or purchase our products. We may require you to affirmatively accept these Terms at checkout; completing a purchase constitutes acceptance whether or not such a checkbox is presented.

02 · Changes to these terms

We may revise these Terms at any time by posting an updated version on this page with a new “last updated” date. Material changes will, where reasonably possible, be communicated by email to customers and subscribers. Your continued use of the site or maintenance of an active subscription after changes take effect constitutes acceptance of the revised Terms. It is your responsibility to review this page periodically.

03 · Eligibility & accounts

You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to keep it updated. We reserve the right to suspend or terminate any account, cancel any order, or refuse service to anyone, at our sole discretion, including for suspected fraud, abuse, reseller activity, or violation of these Terms.

04 · Product representation

Every product is photographed and described in good faith. Because PHOS is made in small batches, the exact bottle, cap, or label you receive may vary slightly from the images shown — bottle shape, size, closure, and finish can change between production runs. What never changes is the formula and the four oils inside. By ordering, you accept that minor packaging variation between batches is normal and not grounds for return on that basis alone. If a product cannot ship at all, your order is refunded in full.

05 · Cosmetic use & no medical claims

PHOS is a topical cosmetic intended for external use on hair and scalp only. It is not a drug, treatment, or cure for any condition, and nothing on this site has been evaluated by the U.S. Food and Drug Administration. Statements about thickness, growth, frizz, or shine describe typical cosmetic experience and individual customer reports — they are not guarantees and results vary by person. Do not ingest. Keep out of reach of children. Patch-test before first use; discontinue immediately if irritation, redness, or discomfort occurs, and consult a physician if symptoms persist. If you are pregnant, nursing, or have a known sensitivity to any listed botanical, consult a healthcare professional before use.

06 · Orders & acceptance

Your submission of an order is an offer to purchase. All orders are subject to acceptance and availability, and no contract is formed until we confirm shipment. We may, without liability, limit quantities, reject, or cancel any order — including after a confirmation has been sent — for reasons including stock limits, suspected fraud, or pricing errors. If we cancel an order you have already paid for, we will refund the amount charged.

07 · Pricing & promotions

Prices are listed in U.S. dollars and exclude taxes and shipping unless stated. Promotional discounts apply at checkout. Bundle discounts (Solo / Duo / Trio) and Subscribe & Save are calculated automatically on the listed unit price and may stack with each other but not with other site-wide promotions unless explicitly noted. We reserve the right to change prices, discontinue products, or correct pricing and typographical errors at any time before shipment, even after an order is placed.

08 · Payment

Payment is processed at checkout by our third-party payment processors (including Shopify Payments). By submitting payment information, you represent that you are authorized to use the payment method and authorize us to charge the full order amount, including taxes and shipping. We do not store full card numbers. You are responsible for any bank, card, or currency-conversion fees imposed by your provider.

09 · Subscriptions & recurring billing

Subscribe & Save deliveries renew automatically at the cadence you select (30 / 60 / 90 / 120 / 180 days) using your saved payment method, at the then-current subscription price, until cancelled. You will receive an email at least three days before each renewal. You may skip, pause, change cadence, or cancel any active subscription at any time from your account; changes apply to shipments not yet processed. By enrolling, you authorize these recurring charges. We may update subscription pricing with advance notice.

10 · 30-day promise & returns

If your hair does not love this oil, you may return what is left of the bottle within 30 days of receipt for a full refund of the product price. Email hello@phos-studios.com with your order number to begin. We cover return shipping inside the U.S. No questions, no restocking fee. Refunds are issued to the original payment method within 5–10 business days of our receiving the return. Shipping charges (where applicable) and gift-wrap fees are non-refundable. The promise applies once per customer per product.

11 · Shipping & risk of loss

Orders placed before 2pm PT generally ship the same business day; otherwise the next business day. Standard delivery is 3–5 business days domestic and 7–14 days international, subject to carrier delays outside our control. Title and risk of loss pass to you upon delivery to the carrier. Lost or visibly damaged packages reported within seven days of the delivery date will be reshipped at our cost. International customers are the importer of record and responsible for any duties, taxes, or customs fees not collected at checkout.

12 · Cancellations & modifications

We begin processing orders quickly, so we cannot guarantee that a change or cancellation request can be honored once an order is placed. Email us as soon as possible and we will do our best. Once an order has shipped it cannot be cancelled, but it remains eligible for the 30-day promise.

13 · Acceptable use

You agree not to misuse the site: no scraping, reverse engineering, automated ordering, interfering with site security, infringing our intellectual property, reselling products without authorization, or using the site for any unlawful purpose. We may suspend access or cancel orders for any violation.

14 · Intellectual property

The PHOS name, logo, bottle and packaging design, label artwork, product photography, written copy, and the code and design of this site are owned by PHOS or its licensors and protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission. The botanical formula and its ratios are proprietary and confidential.

15 · User content & reviews

If you submit a review, photo, comment, or other content, you grant PHOS a perpetual, worldwide, royalty-free license to use, display, reproduce, and adapt that content for marketing and operational purposes, with attribution by first name where shown. You represent that the content is yours to share, is accurate, and does not violate anyone’s rights. We may edit for length or clarity, or decline to publish, at our discretion.

16 · Third-party links & services

The site may link to or integrate third-party services (payment, shipping, email, analytics, subscription management). We are not responsible for the content, policies, or practices of third parties, and your use of those services is governed by their own terms.

17 · Disclaimer of warranties

To the fullest extent permitted by law, the site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any specific result will be achieved from product use. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

18 · Limitation of liability

To the maximum extent permitted by law, PHOS and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the site or products. PHOS’s total aggregate liability for any claim arising from a product or order will not exceed the amount you actually paid for that product. This limitation applies regardless of the legal theory and even if PHOS was advised of the possibility of such damages.

19 · Indemnification

You agree to indemnify and hold harmless PHOS and its affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the site, your violation of these Terms, or your violation of any law or third-party right.

20 · Binding arbitration & waiver of suit

By purchasing, you agree that any dispute, claim, or controversy arising out of or relating to a PHOS product, order, or these Terms will be resolved exclusively through final and binding individual arbitration administered in the State of New Jersey under the rules of the American Arbitration Association — not in court. You waive any right to file or participate in a lawsuit, jury trial, or class, collective, or representative action against PHOS. Nothing here prevents either party from seeking relief in small-claims court for qualifying claims. You may opt out of this arbitration agreement by emailing hello@phos-studios.com within 30 days of your first purchase.

21 · Governing law & venue

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. Subject to the arbitration provision above, any permitted proceeding will take place in the state or federal courts located in New Jersey, and you consent to that jurisdiction and venue.

22 · Severability & waiver

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.

23 · Entire agreement

These Terms, together with our Privacy Policy and any order-specific terms presented at checkout, constitute the entire agreement between you and PHOS regarding the site and products, and supersede any prior agreements or understandings.
